Could be it depends whether you have a cruise control capable ECU. EDC17C10 for example. If you have an EDC16C3x then it maybe doesn't work.

This is fixed on the B9, you can't touch the brake & throttle together or the throttle is cut to zero, as it should be on any drive by wire system (electronic pedal). I would have thought the M5...
