Road tax- am i in trouble here? :-S

Hello, am in bad mood now! :censored: Tried to tax the berlingo twice this week to no avail. When I bought it a few weeks ago from the dealer, i took money in to get it taxed but he told me it was taxed til end of Feb.

So I tried to tax it online on Sunday... and it's classed as disabled tax. I should have noticed but I didn't. Online it said go to post office to change details. So I went today (last minute again) & they can't do it! :brickwall: So I have to go to the godforsaken :censored: DVLA office in Manchester. And i can't even drive there because that'll offend the police, the DVLA, the Queen, her corgis, :censored: Uncle Tom Cobley...

Problem is that Ive been unwittingly driving around with the wrong tax disc, am i in trouble or likely to be fined? is the question... :S

I would be going back to the place where you bought the car from, it was their responsibility to notice the tax disk was for a disabled persons.

I agree with Philip that the garage is at fault, but that is not a valid excuse at the roadside.illyme:
As most offences are spotted by ANPR cameras these days then your car should come up as taxed, although there may be a marker on PNC for change of keeper.
The fine is upto £1,000 (!), but if caught you would probably get away with a £60 fixed penalty.

It is the responsibility of the previous vehicle owner to surrender a tax disc of the Disabled Category, in this instance either the previous owner or the dealer should have taken off the disc and surrendered it to the DVLA.

It is a massive pain. I once bought an ex-disabled registered car and had to go to the local DVLA office to get the classification changed. You can't re-tax it without this. I also wasn't told by the selling dealer so was really pissed off about the whole thing.

As far as getting in trouble goes, if the road tax hasn't run out, it's got MOT and insurance then you should be fine (at least as far as ANPR checks go) but the hassle is when you need to renew the tax.

Chris, the law is won and lost on technicalities.....

Not sure if it would be viewed as an attempt to defraud the DHSS or DVLA but I know for sure that it does state, on the documentation used to tax a vehicle in the disabled criteria, that the disc must be surrendered on sale or cessation of ownership of that vehicle and that the person claiming the disabled entitlement can only use that entitlement on one vehicle at a time....

It's much easier the other way round. When I sold my Mercedes V Class and bought Bernie I Surrendered the old disabled tax disc on the Merc, Changed my disabled entitlement over to Bernie and Taxed her all in one visit to the Post Office. Bernie also had 10 months tax left to run so I was able to surrender that and get a refund. All in all very painless indeed.

It's fine, I just bought a berlingo that was classed as disabled and taxed it with no probs at all.

Take your new keepers supplement, v10 form, mot and insurance to the local dvla office and just note on the form which class of tax you are applying for. I also made a note of the change in class when I sent off my V5. Sorted.

ETA: some post offices can do this as well, but not all, check online with dvla.

Hello everyone, thanks for all your help. The last time i went to DVLA office in Manchester was a few years ago, I was there hours & it was a nightmare.

This time, i had no problems at all. I was out & taxed in 30 minutes & the staff were lovely!

Then i found out that despite all these improvements, the government are trying to close the Manchester office down- typical!

I am sure that you are right and it was a few years ago. I remember that I could not tax it at the post office after buying the car because the V5 stated the disabled classification. I then had to go to the local DVLA office who changed the taxation class and issued a tax disc.
