Hi all,
We have an 03 Berlingo from new, spring broke a month or so ago, sent to local garage & got it fixed and tyre replaced.
Didn't know about the recall regarding suspension spring cups,phoned Citroen UK they said t'was done in 2005- it clearly was not!
We have the invoice/advice note from the supposed repair, and no mention of any cups being fitted. Our garage will attest that no cups were fitted.
Do I have a case for damage caused by broken spring?

A very tenuous case and probably costing more than the damage in the first place.
Note well they will have corporate lawyers who will be more slippery than a greased-up slipppery thing on ice. Leaned back in a chair with a Blackberry in one hand and a Latte in the other.
Looking smug.
About a decade ago I had a cats eye (wait for the funnies...?) pop out of the road and punch through the wheel and new tyre on one of my Astra's.
It was during a replacement programme at the time and all the photo's I took pointed to their negligence and still they weaseled out of it.
And that was just our third-rate local council.
Putting your understandable annoyance to one side for a moment, consider that you will need lots of time,money,patience and tenacity especially if you want pursue it for the principle alone.
I would suggest you put it down to experience.
It is on my to do list.

I heartily disagree with your acceptance of the situation in that to accept corporate bullying is to encourage it and also that according to VOSA ( with whom I spoke earlier), Citroen have an obligation to ensure that any possible safety recalls are followed up.
Either they or the dealers are mistaken or more likely lying when they insist that the suspension cups were fitted. I am surprised and not a little dissappointed to receive no helpful input or even encouragement from this forum. Perhaps next time I post, I'll include a little piccie of our "go faster" stripes-that'll probably float more boats.

Steady on chap! If I were seeking legal advice, I'd look elsewhere. The fact is, I thought that a forum of Berlingo owners may possibly include those who've had experience of this occurrence and go from there.
Although I doubt that this would go as far as seeking legal redress. If it did then your accurate picture of corporate lawyers and the cost associated with the same may not be a problem.
The costs in question amount to no more than a "small claim" and if this were suitable to heard in that court or more likely a fast track or mediation, then their costs would be severely limited.
I can't see that happening though, but I will continue with this in the firm belief-- that what we allow, we encourage.

I'm not sure how you would prove that the cups had not been fitted 7 years ago? If the shocks had been changed and the cups not swapped to the new shocks?
Just a thought.
